Similarly, the Secretary of the Ministry under which the employee is posted has the right to stop the pension and gratuity. The CAG has the right to stop the gratuity and pension of employees who have retired from the Audit and Accounts Department.
According to the new rules for central government employees, if any departmental or judicial action has been taken against the employees during their service, information about it must also be provided to the concerned authorities. This rule will also apply to employees working on contract after retirement.
If an employee retires and gets pension and gratuity and it is proven that he committed a mistake during his service, the government can recover the money from him. In such cases, recommendations should be obtained from the UPSC. At the same time, the pension can be stopped only when the minimum pension is Rs. 9000.
As per this new rule of the government under the 7th Pay Commission, if an employee’s pension or gratuity is stopped or reduced, the employee will be paid a minimum fixed amount of Rs. 9000 per month as per the already prescribed rule 44.
