While giving the verdict in a case of Kerala High Court, it has been said that the department will have to give accurate information as to what kind of misrepresentation, fraud or attempt to hide the facts has been committed by the businessman while taking the GST number.
An important decision of the Kerala High Court has come against the department’s decision to arbitrarily cancel the GST registration. The GST registration of Anil Kumar Madhusudan, a businessman from Kottayam, was issued a one-line show cause notice by the department, against which he approached the Kerala High Court. Giving relief to the petitioner, the court ruled that the department cannot do this.
Under the CGST and SGST Act 2017, the department has the right to cancel or suspend GST registration…but the High Court has clearly said in its decision that without hearing the petitioner’s side and without giving true and accurate reasons.
