There is a big update on pension payment and recovery for pensioners across the country. Actually, big news has come out regarding the amount of pension.
For this, the CPAO has issued instructions. For which notification has been issued on recovery of the amount of payment made to pensioners under Rule 64 (4) of CCS (Pension) Rules 2021.
Attention is invited to RBI circular dated January 21, 2021 regarding withdrawal of circulars on recovery of additional pension made to pensioners. RBI decided that the following circular issued by the Government and Bank Accounts Department, Reserve Bank of India relating to recovery of additional pension made by agency banks has been withdrawn from the date of issue.
It was further stated that the agency banks would seek guidance from the concerned pension sanctioning authorities regarding the procedure to be followed for recovery of excess pension paid to the pensioners. The Department of Pension and Pensioners’ Welfare has clarified (copy attached) that the question of recovery or exemption of any additional payment under Rule 66(4) of CCS (Pension) Rules, 2021 due to error in initial authorization or revision of pension by the office to be dealt with accordingly.
Thus, the question of recovery or waiver of recovery of any excess payment on account of error in the initial authorization or revision of pension by the office is to be dealt with in accordance with Rule 66(4) of the said CCS (Pension). Issuing the order, Rule 2021, which refers to the Supreme Court’s decision in Rafiq Masih’s case and DoPT’s Office Memorandum dated 2.3.2016. Therefore, due to an error on the part of the office, there does not appear to be a need to issue further instructions regarding handling of overpayment to pensioners.
