New Delhi. The government has amended rules to ensure a transparent process at the time of physical verification of registered addresses of companies. Now at the time of verification, the method of taking photograph of the registered company office and the presence of independent witnesses will be adopted. The Ministry of Corporate Affairs has amended the verification rules prescribed under the Companies Act, 2014 for this purpose and will come into force as soon as it is notified in the official gazette.

Registrar of Companies can take this decision

According to the news of PTI, under Section 12 of the Act, if the Registrar of Companies finds that a company is not doing business properly, then he can do a physical verification of its registered address. With this amendment, the process of such physical verification has been fixed.

The presence of two independent witnesses at the local level is necessary.

The Ministry of Corporate Affairs said that the presence of two independent witnesses at the local level would be necessary while doing physical verification of the registered addresses of companies. If necessary, the help of the local police can also be taken. It will also be necessary to examine the documents of the building attached to the address given at the time of registration of the company. Apart from this, a picture of the place with that registered address will also be taken. After this verification is completed, a detailed report will be prepared with the relevant information.

At the time of physical verification, if it is found that correspondence cannot be done at the registered address, the Registrar concerned shall send a notice to the company and its directors asking them to furnish the information.

On the basis of the reply received from the company, it will be decided whether the name of that company should be removed from the government records or not. A provision to this effect has been made through amendment in the Companies Act 2014.
