New MV Act 2019: If a minor child is asking you to drive a vehicle, then refuse him. There is no need to indulge in pampering, because very stringent provisions have been made in the Motor Vehicles Amendment Act 2019. In this, if a minor rider is found on any vehicle then the registration of the vehicle can be cancelled. Not only this, the parents and the vehicle owner will also have to face strict action.

At the same time, if a youth of 16 to 18 years is found driving a vehicle like Scooty-Activa on ‘without gear’ license, then he may have to pay a fine of Rs 5 thousand. Without gear license does not mean driving Activa-Scooty

First of all, understand that without gear license is issued for youth of 16 to 18 years of age. This does not mean that children can drive Activa and Scooty without gear. In common parlance, vehicles like gear less scooter, Activa are considered without gear. However, it is not like that. Without gear means driving a vehicle with less than 50 cc capacity. Activa, Jupiter etc. two wheelers are of 100-125 cc. Definitions regarding this are given in Section 2 of the Motor Vehicles Act 1988. Where it is clearly written that without gear is a vehicle with capacity less than 50 cc and with gear is a vehicle with capacity more than 50 cc.

There is a fine of Rs 5,000 for not getting the driving category.

If a teenager (16-18 years) is found driving a vehicle with gear instead of without gear, then a challan will be issued for not getting driving category. Under which a fine of Rs 5000 has been fixed. However, state governments also have the right to amend this fine. In view of the recent increase in the number of children driving vehicles, instructions have been issued to the concerned departments to keep an eye on it.

Major action will be taken if a minor rider is found driving a vehicle

If a minor child is caught driving a vehicle, the vehicle owner or parents will have to face serious action. In such cases, the registration of the vehicle may also be cancelled. Fine will also have to be paid. Whereas the license of a minor will not be issued before the age of 25 years.
