SLP rejected
In fact, orders were issued by the High Court in Jharkhand against giving the benefit of equal pay for equal work to Home Guard soldiers. Against which the state government had filed an SLP in the Supreme Court. After the hearing on Friday, the division bench of Supreme Court Justice GK Maheshwari and Vishwanathan rejected the SLP. With the rejection of the SLP of the state government, an increase in the salaries of the soldiers will be seen. In fact, they will be paid the same salary as a constable under equal pay for equal work.
Equal pay for equal work
The Supreme Court, while rejecting the government’s petition, said that the order of the Jharkhand High Court should be followed without any delay and Home Guard soldiers should be given equal pay for equal work. The state government had challenged the High Court order in the Supreme Court.
Let us tell you that Advocate Ajaykant Mishra, on behalf of the High Court organization, said during the hearing that the single and double bench of the High Court had ordered the Jharkhand government to give equal pay for equal work. Instructions were given to implement within 3 months but additional time of 6 months was demanded by the state government.
However, even after being given 6 months time, it was not implemented by the Jharkhand government. After which, on behalf of their organization, Ravi Mukherjee and Rajesh Tiwari had filed a contempt petition in the High Court and to avoid contempt, an SLP was filed in the Supreme Court by the state government 4 months ago.
Benefits to more than 20,000 Home Guard soldiers
Now the state government’s petition has been rejected in the Supreme Court. With which more than 20,000 Home Guard soldiers will benefit. The Supreme Court had issued the order in the year 2015 itself. In which it was said that employees would be paid equal wages for equal work. Although this system was implemented in Chhattisgarh, Uttar Pradesh, Bihar, it was not implemented by the Jharkhand government.
In Jharkhand, Home Guard soldiers were being paid a salary of Rs 500 per day. A petition was filed in the High Court in 2018. In 2019, the single bench had given its verdict in favor of the Home Guards. After which SLP was issued in the double match of the High Court. Which was rejected on 12 January. The double bench had said that the decision of the single bench is correct. Equal pay will be given for equal work. Three months time was also given for this.
However, now the way has been cleared after the petition was filed in the Supreme Court. More than 20,000 Home Guard soldiers will now be paid salaries ranging from Rs 21,000 to Rs 22,000. They will be provided other facilities including salary on the same scale as a constable. In the matter, Ravi Mukherjee said that until equal work is done, equal pay is not implemented.
A petition will be filed in the High Court for payment of arrears from the year 2018 onwards. A similar complaint was filed in Bihar also. Home Guard soldiers in Uttar Pradesh have received the benefit of arrears amount.
Now preparations are being made to file a petition in Jharkhand also. If the decision comes in favor of Home Guards for the area of Home Guard jawans also, then in such a situation a huge amount can be seen in the account of Home Guard jawans.
