H-1B Visa New Rules: The US Citizenship and Immigration Services (USCIS) has released a new version of Form I-129 for H-1B visas, which will be mandatory from January 17, 2025.
H-1B Visa New Rules: Under the H-1B visa, US companies can temporarily hire foreign professionals in “specialty occupations”. This includes fields such as technology, software development, engineering, healthcare, education, and business. These jobs require at least a bachelor’s degree or equivalent qualification.
Form I-129 before January 17, 2025 will not be accepted. USCIS has made these changes for H-1B and H-2 visa modernization. This will make the visa process more systematic and transparent.
Who will be affected by this change?
This change will also apply to other worker visas such as H-2A, H-2B, H-3, L-1, O-1, O-2, and P categories apart from H-1B. Q-1 and R-1 categories for religious and cultural exchange workers will also come under this purview. The registration process for H-1B visa will be online. Applicants will have to register on the USCIS portal and deposit the fee. Registration will last for 14 days. After this, USCIS will select eligible candidates through a selection process, who can file a visa petition.
