Income Tax: In disputed income tax cases, despite the decision coming in favor of the taxpayer, it takes a lot of time to get the refund. This problem is going to end. Actually, the taxpayer has to apply again to the Income Tax Department to comply with the order. Since this process is offline, it takes a lot of time to get the refund. This means that the refund money remains stuck for a long time. Now this problem is going to end. Let’s know about this in detail.

Finance Minister Nirmala Sitharaman said in the Union Budget 2025, “I had promised in my speech (budget) of July 2024 that all processes would be digitized and made paperless within the next two years. This will also include orders related to appeals. I am happy to announce that now the process is being digitized.” After this order of the Finance Minister, the Income Tax Department has started a new feature on its e-filing portal.

This feature is available on the e-filing portal under the name ‘Request for Order Giving Effect’. With the use of this feature, the order on the appeal will now be implemented soon. It will not take much time to comply with the appeal as before. To understand the benefits of this feature, it is important to understand the existing system.

If a taxpayer is dissatisfied with the order of the Income Tax Department, then he appeals against it in the Commissioner of Income Tax (Appeals), Income Tax Appellate Tribunal (ITAT), High Court or Supreme Court. For this, he has to deposit the amount related to the dispute along with the appeal. If after hearing the appeal, the decision comes in favor of the taxpayer, then he has to apply again to the Income Tax Department to comply with the decision. Only after this the decision is implemented and he gets back the amount deposited by him. This whole process takes a lot of time.

What does this mean for taxpayers?

1. Quick settlement of appeal: With the new feature, the time taken to comply with the order on appeal will be reduced significantly. Due to this, taxpayers will not have to wait for a long time for refund or necessary adjustment.

2. No need to visit the tax office again and again: Chartered accountants, tax advocates and taxpayers will not have to visit the income tax office again and again.

3. Easy and transparent process: With digitalization, taxpayers will now be able to submit their request online. This will make the whole process easy and transparent.

This is a welcome step towards modernizing India’s tax administration. This will provide a lot of convenience to taxpayers. Also, their trust in the system will increase.

How to use this new feature?

To implement the order on appeal, you have to follow the following steps:

1. You have to login to the Income Tax e-filing portal. For this, you have to go to https://www.incometax.gov.in/iec/foportal/. You have to log in through your ID and password.

2. You have to go to Pending Actions: You have to click on ‘

Go to Pending Actions’. Then select ‘E-Proceedings’. After that you will get the option of ‘Request for Order Giving Effect’.

3. You have to submit a new request: You have to click on ‘New Request’. You have to enter the details of the relevant assessment. After that the request has to be submitted for processing.

Once the request is submitted, the Income Tax Department will process it. This will reduce the time taken to implement the order on appeal.

With this initiative, the government has taken a major step towards eliminating delays caused by bureaucracy and speeding up the tax compliance process. Digitalisation in tax administration will not only make it easier but also reflects the government’s vision to create a more transparent, accountable and taxpayer-friendly system.
