Himachal HC Issues Notice To Kangana Ranaut: Election of BJP MP Kangana Ranaut from Mandi Lok Sabha of Himachal Pradesh was challenged in Himachal High Court. After which the court has sent notice to Kangana. In the petition, there has been a demand to cancel Kangana’s membership of Parliament. The High Court has issued notice to Kangana on this petition. The court has asked Kangana to file her reply by August 21.
This petition against Kangana has been filed by Layak Ram Negi. In the petition, he has asked the court to cancel Kangana’s election. Nayak is a former employee of the Forest Department. He had taken VRS ahead of time. Negi says that he wanted to contest the election, but his nomination papers were wrongly rejected by the Election Officer of Mandi.
Petitioner Negi argues that if his nomination papers were accepted, he would have won. In the petition, Layak Ram Negi has appealed to the court that Kangana’s election should be canceled. He has demanded re-election on Mandi seat. Justice Jyotsna Rewal has issued notice to Kangana on this petition of Negi and has sought reply by August 21.
Negi further said that during the nomination, he was told that he would also have to provide no dues certificates for electricity, water and telephone issued for government accommodation. He was given time till the next day to give this certificate. The next day when he submitted the papers to the Returning Officer, he refused to take it and rejected the nomination.
Actress Kangana Ranaut won from Mandi in Himachal in the Lok Sabha elections. She defeated Congress candidate Vikramaditya Singh by 74,755 votes. Dr. Prakash Chandra Bhardwaj of Bahujan Samajwadi Party was at third place. Bhardwaj got 4393 votes.
The petition can be rejected on this basis
Under Section 100 of the Representation of the People Act, the challenge given to the election in Mandi can be declared invalid by the court. This will happen if the petitioner fails to prove that his nomination paper was rejected illegally.
