New criminal law: These three laws have been brought to completely change the criminal justice system of the country. These three will be the Indian Justice Code, the Indian Civil Defense Code and the Indian Evidence Act. All these will replace IPC.
Bharatiya Nyaya Sanhita: Notification has been issued to implement three new criminal laws passed by the Modi government at the Centre. These laws will be implemented from July 1, 2024. These three new criminal laws will be applicable in place of the Indian Penal Code, Criminal Procedure Code and Evidence Act. These three laws had already received the approval of the President. Then these three bills became law. Now the notification for their implementation has been issued. There is a need to understand how much change has been made in the new laws and how they will be different from the old ones.
In fact, people will now get freedom from the Indian Penal Code, Criminal Procedure Code and Evidence Act which have been in practice since the British era. In this new law, there is a provision for life imprisonment and even death penalty for heinous acts like mob lynching, gang rape of a minor. However, the provisions related to matters related to ‘hint and run’ will not be effective immediately. The aim of all three laws is to completely change the criminal justice system in the country by defining various crimes and prescribing punishment for them.
At the same time, one thing is that the government has decided not to implement the provision related to the cases of hit and run by the vehicle driver, as was promised to the truck drivers. Truck drivers had opposed these provisions.
Now understand some new provisions through examples-
The killing:
- Old section: Section 302 of IPC
- New Section: Section 101
Fraud:
- Old section: Section 420 of IPC
- New Section: Section 316
Attempt to murder:
Old section: Section 307 of IPC
New Section: Section 109
Misdeed:
Old section: Section 376 of IPC
New Section: Section 63
The provisions related to hit and run cases will not come into force immediately.

Earlier rape section was 375, 376,
Now, where the matter of crimes begins, rape has been included in sections 63 and 69.
Murder was 302, now it has become 101.
There is a provision of life imprisonment and death penalty for rape of a girl below 18 years of age.
Those found guilty of gangrape will be punished with imprisonment for up to 20 years or for as long as they are alive.
– Under the new law, Section 302 is related to snatching.
– Section 420 of the IPC was the crime of cheating, but the new law does not have that number of sections. Fraud comes under section 316 of the Indian Judicial Code.
– Section 144 of IPC related to illegal assembly will now be called Section 187.
– Similarly, Section 121 of the IPC, which deals with waging war, or attempting to wage war, or instigating the waging of war against the Government of India, will now be called Section 146.
– Section 499 of the IPC, which deals with defamation, now comes under Section 354 of the new law.
– Section 376 related to the punishment of rape under IPC is now Section 63. Under the new law, Section 64 deals with punishment, while Section 70 deals with the offense of gang rape.
– Section 124-A of the IPC, which deals with sedition, is now known as Section 150 under the new law.
IPC:
The number of streams has reduced from 511 to 356.
Changes have been made in 175 sections.
8 new sections have been added.
22 sections have been removed.
CRPC:
The number of streams has decreased from 533 to 524.
Changes have been made in 160 sections.
9 new sections have been added.
9 sections have been removed.
Apart from this, there were many such popular streams which have been changed, or their stream numbers have been changed. Now these will come into vogue from July 1st. It is also important for everyone to study them.
