The Central Government will give the benefit of Old Pension Scheme to some employees coming under the National Pension Scheme. According to Dr. Jitendra Singh, Minister of State in the PMO, after the order of the High Court, it is being implemented.


The Central Government has decided to give the benefit of Old Pension Scheme to the employees coming under the National Pension Scheme. According to Dr. Jitendra Singh, Minister of State in the Ministry of Personnel, Public Grievances and Pensions and PMO, after the order of the High Court in this regard, it is being implemented. This will benefit those employees whose advertisements were published before 01/01/2004 and their results came after 31.12.2003 or appointments were made after 31/12/2003. What is the matter

Let us tell you that a writ was filed in the Delhi High Court. On this, on 28 January 2020, the court accepted the writ petition. The court had said that some employees were given jobs according to a selection process, which was completed in February 2004. But the court does not agree with this. The employee is not responsible when the advertisement came out in May 2003 and the selection process was over in February 2004. This delay was on the part of the government. After this, the court ordered the petitioner to give the benefit of the old pension scheme under the Central Civil Services (Pension) Rules, 1972.

Jitendra Singh stated that this decision was not in accordance with the notification issued by the Ministry of Finance (Department of Economic Affairs) dated 22.12.2003. Hence an SLP was filed in the Supreme Court. But the Court rejected it on 04.02.2021.

When did NPS come?

Jitendra Singh informed that the Ministry of Finance had started the National Pension System (NPS) for the Central Government employees on the notification dated 22 December 2003. National Pension System (NPS) is mandatory for all new appointments (except armed forces) to the Central Government service with effect from January 1, 2004.

However, after the court decision, the government decided to implement it completely. With this, such Government servants who were declared successful for recruitment to the vacancies arising before 01.01.2004 in the results declared on 31.12.2003 and on posting in service on or after 01.01.2004 will be covered under National Pension System. Gaya can be given a one time option to be covered under the Central Civil Services (Pension) Rules, 1972.

Whether the Supreme Court has set aside the Special Leave for Appeal (Civil) 173/2021 dated 04.02.2021 and allowed such Central Government employees covered under the National Pension Scheme to take advantage of the old pension scheme whose advertisement were published before 01/01/2004 and their result came after 31.12.2003 or appointment was made after 31/12/2003?
  2. Will the government issue general orders for similar cases to reduce the burden of litigation and resources—the exchequer and its officials—on that decision?
