In such a situation, the police often take away the keys of the motor vehicle. But, is it legally correct to do so? No, the traffic policemen cannot take away the vehicle keys from any motor vehicle owner.

What does the law say?

According to the Motor Vehicles Act 1932, ‘The traffic policeman cannot forcefully take away the keys of your car, it is illegal to do so. No police officer, irrespective of his position or authority, can take away the keys of your car.

Answer in the language of law

If a policeman ever does this to you, you can refer them to the Motor Vehicles Act, 1932. He will understand that you are knowledgeable about the law and know how to put your point in a legal way. No action can be taken against you for this.

This is also the rule

According to Section 130 of the Motor Vehicles Act, when a police officer asks for documents from you, all you have to do is show your documents. If the policeman asks you to hand over the DL etc., then it is entirely up to you whether you hand over the documents to him or not.

However, in some cases the police officer can confiscate your license, in that case they will definitely take your license. But, then you have to make sure that the traffic police department gives you a valid receipt in lieu of the license being impounded.
