Pakistan Supreme Court has given a big blow to Imran Khan. The court dismissed the deputy speaker’s decision as unconstitutional.
The Pakistani Supreme Court on Thursday gave a big blow to Imran Khan. The court termed the deputy speaker’s decision to dismiss the no-confidence motion as unconstitutional. Also said that it was illegal for Prime Minister Imran Khan to ask the President to dissolve Parliament. After the decision of the court, the decision to dissolve Parliament was also quashed. With this, Parliament has been restored and voting will be held on the no-confidence motion on April 9.
The court also announced that the prime minister and federal ministers, ministers of state, advisors, etc. would be reinstated. The Court further ruled that the session of the National Assembly on the no-confidence motion should be held on Saturday and should not be adjourned till the vote on the motion is held. If Imran Khan’s government falls, the new leader of the house will have to be elected in the same session. During this time the Speaker shall not exercise his powers under clause (3) of Article 54 of the Constitution.
Prime Minister Imran Khan held a meeting with his legal team ahead of the court’s decision. After this, he said that whatever the decision is, Pakistan Tehreek-e-Insaf (PTI) will accept it. Pakistan’s ARY News gave this information. After the decision came, he called a cabinet meeting on Friday and said that he would address the nation. The court had reserved its decision while hearing the matter earlier in the day. During this, Chief Justice of Pakistan (CJP) Umar Ata Bandyal had said that Deputy Speaker Qasim Suri’s decision to reject the no-confidence motion against the Imran government was in violation of Article 95.

If everything is done according to the constitution, then where is the crisis? During the hearing, the Chief Justice questioned President Arif Alvi’s lawyer that if everything happens according to the Constitution, then where is the crisis? According to the report of Pakistani newspaper Dawn, the petition has been asked whether the former Prime Minister of Pakistan Imran Khan and his associates have the legal right to dissolve Parliament?
The CJP took suo motu cognizance of the constitutional crisis- Barrister Ali Zafar, representing President Arif Alvi, at the beginning of the hearing, assured the court of completing its arguments within 10 minutes, reports Geo News. Significantly, the CJP had taken suo motu cognizance of the constitutional crisis, which started after Suri’s April 3 vote on the resolution termed as “unconstitutional”. His move was termed by the opposition as a violation of the Constitution. The judge, in a written judgment issued during Sunday’s hearing, said that his fellow judges had contacted him and expressed concern over the situation, Geo News reported.
