The Lucknow Bench of the High Court has given its verdict on the reservation system for seats in the UP Panchayat elections. The High Court said that reservation should be implemented on the seats considering 2015 as the basis. Earlier, the state government said that it is ready to implement reservation system by considering 2015 as the base. On this, a division bench of Justice Rituraj Awasthi and Justice Manish Mathur has ordered the UP Panchayat elections to be held by May 25 .
Let us tell you that the order of 11 February 2021 was challenged by a petition in the Lucknow Bench of the High Court. The petition states that under Rule 4 of the Rules for the implementation of reservation in Panchayat elections, reservation is applied to the seats of Zilla Panchayat, Setra Panchayat and Gram Panchayat. It was said that the elections of 1995, 2000, 2005 and 2010 were held, considering the year 1995 as the original year in relation to the implementation of reservation.
The petition further stated that issuing a mandate on 16 September 2015, it was asked to implement the reservation considering the year 2015 as the original year instead of the year 1995. In the said mandate itself, it has been said that according to the census of 2001 and 2011, a large amount of demographic change has taken place. Therefore, it will not be appropriate to implement the reservation considering the year 1995 as the original year. It was said that the mandate of 11 February 2021 was implemented, ignoring the said mandate of 16 September 2015. In which the year 1995 has been considered as the original year. It was also said that the Panchayat elections of the year 2015 were also conducted according to the mandate of 16 September 2015.
Preparations for the panchayat elections are in full swing in UP. Reservation list has been issued in many districts. The reservation was finally finalized after the DM’s seal. This reservation list has been pasted on Zilla Panchayat and Block. Objections will now be taken from March 4 to 8 on this reservation list issued. After the hearing, the final list of reservation will be published from 13 to 14 March. From 11 February, there is a struggle for reservation of Zilla Panchayat members, BDCs and village heads.
According to the details received from the State Election Commission, the nominee for the post of Gram Panchayat member will have to pay a nomination fee of Rs 150 and a security deposit of Rs 500. The candidate for the post of village head will have to pay a nomination fee of Rs 300 and a security deposit of Rs 2000. In the same order, the Kshetriya Panchayat member will have to pay a nomination fee of Rs 300 and a security deposit of Rs 2000 and a fee of Rs 500 for the Zilla Panchayat member and a bail amount of Rs 4000. If the candidate belongs to Scheduled Tribe, Scheduled Caste, Backward Class or Women category, then they will have to pay half the amount of nomination fee and bail amount.
